1. Acceptance
By opening an account you agree to these terms. American Digital Assets is a digital asset services company headquartered in New York, New York. We are not a bank, we do not take deposits of U.S. dollars for banking purposes, and digital assets held with us are not insured deposits.
2. Eligibility and verification
You must be at least 18 years old and able to enter a binding contract. You must complete identity verification, including document and liveness checks, before sending or withdrawing digital assets. We may refuse, limit or close an account where verification cannot be completed.
3. Your account
- Keep your credentials confidential and enable multi-factor authentication.
- You are responsible for all activity conducted through your account.
- Notify us immediately of any suspected unauthorized access.
4. Transfers and fees
Every send and withdrawal displays the applicable network fee and service fee before you confirm. Blockchain transactions are irreversible once broadcast. You are solely responsible for the accuracy of destination addresses and selected networks; assets sent to an incorrect address or network may be permanently lost.
5. Prohibited use
You may not use the platform for unlawful activity, sanctions evasion, market manipulation, or on behalf of an undisclosed third party. We screen transactions and may freeze activity where legally required.
6. Suspension and termination
We may suspend or terminate access where required by law, regulation, a court order, or where we reasonably suspect fraud or a security compromise.
7. Disclaimers and liability
Services are provided on an "as is" basis. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for losses arising from blockchain network conditions outside our control.
8. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict of law principles.
